| Herley Industries, Inc. Derivative Litigation for Gross Mismanagement |

| Gardy & Notis, LLP has been appointed by the Court as lead counsel for shareholders of Herley Industries, Inc. (NASDAQ: HRLY) seeking to recoup damages against Herley's board of directors for permitting the company's former Chairman and Chief Executive Officer, Lee N. Blatt, to submit fabricated bids for contracts with the U.S. Department of Defense. Herley and Blatt were indicted in connection with the fabricated bids, which were submitted at the time of the defendants' directorship of the company. Herley and Blatt have since pleaded guilty to criminal charges. The case is Blair v. Blatt, Case No. 06 Civ. 2964, in the United States District Court for the Eastern District of Pennsylvania. Defendants' motions to dismiss were denied on July 20, 2007. The case is currently in discovery. No trial date has been set.
